The following terms and conditions will apply to your booking. Please read them carefully as you will  be bound by them.

1.The Contract

By booking a trip with Meru Holidays, you agree to be bound by these terms and conditions. if you do not agree to the terms and conditions, you will not be able to participate in the programs that are conducted.

Upon receipt of your deposit by Meru Holidays, a copy of the terms and conditions will be sent to you. You must sign and return the signed version of the terms and conditions to Meru Holidays to be able to participate in the program. By signing the terms and conditions, you acknowledge that you have received, carefully read, fully understand, agree and accept the terms and conditions.

A booking is complete and the terms and conditions effective on the date when Meru Holidays sends you a confirmation email.

2. Payment Policy

A. Deposit Payments

Tours outside Karnataka

  • At the time of booking, a deposit of 50% advance on price quoted is due from the day the program is announced.

  • If the booking is made 20 days prior to departure, 50% payment is due. Failing to pay the advance, Meru Holidays reserves the right to regard the booking as cancelled.

  • If the booking is made 10 days or less prior to departure,full payment is due. Failing to pay the full payment, Meru Holidays reserves the right to regard the booking as cancelled.

  • At the time of booking, a deposit of 50% advance on price quoted is due from the day the program is announced.

  • If the booking is made 60 days prior to departure, 50% payment is due. Failing to pay the advance, Meru Holidays reserves the right to regard the booking as cancelled.

  • If the booking is made 30 days or less prior to departure,full payment is due. Failing to pay the full payment, Meru Holidays reserves the right to regard the booking as cancelled.

B. Any cancellation must be made in writing and be acknowledged by Meru Holidays in writing. The date on which the request to cancel is received by Meru Holidays will determine the cancellation fees applicable.

3. Cancellation by you

A. If you must cancel your trip, the following cancellation fees apply.

  • 20 days or more, before the departure: 0% of advance.

  • 10-19 days before departure 50% of advance.

  • 5-9 days 50% of full amount.

  • 0-4 days 100% of full amount.

  • 60 days or more, before the departure: 0% of advance.

  • 30-59 days before departure 50% of advance.

  • 15-19 days 50% of full amount.

  • 0-14 days 100% of full amount.

4. Cancellation by Meru Holidays

A. Meru Holidays will not cancel a tour once it is confirmed except for unusual or unforeseen circumstances outside Meru Holidays control. when a tour is cancelled by Meru Holidays before the date of departure for any reason other than the fault of you, you can:

  • Take a substitute tour with Meru Holidays if such a substitute is available,or

a.If you request an alternative tour of higher value than that originally booked, then you must pay the difference in price.

b.If you request an alternative tour of lesser value than that originally booked, then you will be refunded the difference in price.

  • Have a full refund of amount as per the date of notice according to to contract and payment policy.

B. Meru Holidays is not responsible for any incidental expenses or consequential losses and bank transaction charges.

5. Change in Program

A. While Meru Holidays will make every effort to operate all tours as advertised, reasonable changes in the itinerary may be made when deemed necessary or advisable by Meru Holidays. You understand and acknowledge that the nature of this type travel requires considerable flexibility and should allow for reasonable alterations by Meru Holidays. You understand that the route, schedules, itineraries, amenities, accommodations, meals and modes of transportation may be subject to the alteration without prior notice due to local circumstances or events, such as weather and terrain conditions and sickness.

B. If meru holidays makes a major change, you will be informed as soon as practicable if there is sufficient time before departure. The definition of a major change is deemed to be a change affecting either (1) Accommodations for at least two nights of the tour, or (2) At least 50% of the route itinerary of at least two days of the tour.

If Meru Holidays has to make a major change to the tour before departure,Meru Holidays will notify you as quickly as possible and may either

->Withdraw From the contract without penalty; or

->Accept the change and proceed with the tour.

->Changes to the itinerary may happen on a tour as a result of unforeseen circumstances or local situations. Any changes made to the itinerary as a result will be made with the full authority of the Meru Explorer (program escort) and/or Meru Holidays.

  • When a change to the itinerary is deemed by the Meru Explorer (program escort) and/or Meru Holidays to be necessary or advisable, Meru  explorer (Program Escort) and/or Meru Holidays will provide no refund of payments received.

  • If it is not possible to provide a suitable alternative or you reasonably reject any suitable alternatives, Meru Holidays will provide you a refund of any unused tour portions.

6. Rain or Shine

A. You are likely to encounter a variety of weather conditions during the tour. Such conditions could include freezing temperatures, torrential rain, dense fog and strong wind. Meru Explorers (program escorts) are well trained to foresee the conditions and take at most care to ensure safety. You acknowledge that the tour will proceed rain or shine and that weather is not a valid basis for cancellation or a refund, unless the program is cancelled by Meru Holidays.

7. Assumption of the risk

A. You acknowledge that the nature of the Adventure tour programs is risky and that you may be exposed to certain risks, dangers and physical changes greater than those present in your daily life. Such risks include, but are not limited to bodily injury, death or property damage related exposure to harsh and rapidly changing weather condition, potentially dangerous wildlife, long periods of trekking on ardous terrain and vehicle transportation. By Booking  the tour, you acknowledge that you have considered all of the potential risks, dangers and challenges associated with the tour. You expressly assume all such risk and hereby release Meru Holidays from all claims and causes of action arising from any damages, injuries or death resulting from these inherent risks.

8. Limitation of Liability for Suppliers and/or Independent Contractors

A. Meru Holidays purchases services and/or products such as transportation, hotel/homestay accommodations and meals from various independent contractor, such as doctor or other medical personnel, shopkeeper, or instructional concessionaire. while Meru holidays will at all times make every effort to engage or recommend the services of highly reputable and competent local suppliers, Meru Holidays Is not liable for any acts and/or missions by such suppliers.

9. Authority on the tour

A. At all times the decision of Meru explorer will be final on all matters likely to endanger the safety and well being of the program participants. By booking with Meru Holidays, you agree to abide by the authority of the Meru Explorer.

B. Should you fail to comply with the above or commit any illegal act when on the program or, if in the opinion of the Meru Explorer, your behaviour is causing or is likely to cause danger, distress or annoyance to others, Meru Holidays may terminate your travel arrangements without any liability on Meru holidays part and you will not be entitled to any refund for any resulting unused or missed services or costs incurred.

10. Participant’s Responsibility

A. as a participant, your responsibility to Meru Holidays and to other participants includes:

  • Being sufficiently healthy and attaining the proper fitness level to undertake the tour

  • Preparing for the tour by reading all the pre-departure information sent to you by Meru Holidays.

  • Bringing appropriate clothing and equipment

  • Acting in an appropriate and respectful manner in accordance with local customs, cultures and laws.

11. Civil Rights

A. Meru Holidays has zero tolerance policy for any violation of the civil rights of any participant, Escort or other person you may encounter during the program conducted by Meru Holidays including, but not limited to harrasement, discrimination or negative or disrespectful treatment based on gender, sexual orientation, race, national origin, religion or age.

B. As a Participant, you agree to abide by the Meru Holidays zero tolerance policy of civil rights violations and to treat fellow prticipants, escorts and other people you may encounter during the program- regardless of gender, sexual orientation, race, national origin, religion or age- with respect at all times.

C. Should you fail to comply with the above orcomit any act that, in the discretion of the Meru explorer and /or Meru Holidays, constitutes a civil rights violation, Meru Holidays may remove you from the program and/or terminate your travel arrangements without any liability on Meru Holidays part. You will not be entitled to any refund for any resulting or unused or missed services or costs incurred.

12. Medical Release

A. Our programs involve strenuous trekking in a veriety of potentially harsh and unpredictable weather and terrain conditions. Each day may involve approximately 10-18km, which will approximately 5-9 hours of trekking and total elevation gains that may exceed 1500 feet. Terrain is often uneven, steep, rocky and slippery, weather conditions may be foggy, windy and rainy. To that end, our tours are intended for physically fit travellers in good health for their safety and the safety of their fellow traveller. You acknowledge that you are responsible for achieving an appropriate fitness level and for bringing with you all of the appropriate clothing and equipment.

B. You must notify Meru Holidays in writing at the time of booking of any medical conditions, pregnancy, disability or any other mental or physical condition which may affect fitness to participate in this tour. If such a conition arises after booking, you must notify Meru Holidays thereof in writing as soon as practicable. You acknowledge and understand that you are the best judge of your own conditions and limitations and that it is incumbent upon you to fully disclose the full extent of any such conditions and limitations to Meru Holidays. Failure to notify Meru holidays may result in the cancellation of your booking, or removal of you from the program if failure to so notify Meru Holidays may result in the cancellation of your booking, or removal of you from the program if failure to so notify Meru Holidays is discovered after the tour has commenced.

C.You acknowledge and understand that Meru Holidays Reserves right to disqualify you from any program or activity if in Meru Holidays and /or the Meru explorer;s judgement you are incapable of the program or activity and/or your continued participation in the tour will endanger yourself and/or the safety of the group.

D.You acknowledge and understand that destinations visited on the tour may be remote, isolated and removed from medical care facilities.

E.Any questions you may have regarding your physical or medical suitability for a program must be reviewed by your medical practitioner for approval. Meru Holidays cannot offer advice of a medical nature.

F. In the event there is a dispute between you and Meru Holidays in regard to your physical or mental suitability for a trip, the matter will be referred to medical professional at your expense.

G. Meru holidays reserves the right to deny or remove you from the program on reasonable medical grounds.

13. Severability

A. In the event that any term or condition contained herein is unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be served from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.

14. Successors and Assigns

A. These terms and conditions shall inure to the benefit of and be binding upon Meru Holidays and you and respective heirs, legal personal representatives, successors and assigns.

15. Applicable Law

A. These terms and conditions are subject to Indian government law and the exclusive jurisdiction of the Bangalore High court, Karnataka.

B. All the bookings shall be deemed as booked in Karnataka and will be subject to Karnataka law and jurisdiction.

16. Privacy Policy

A. Meru Holidays will provide personal information, as well as any personal information provided in relation to persons whose travel arrangements have been requested by you to suppliers and carriers to enable the operation of the service requested. Meru Holidays will do all that is reasonably possible in endeavouring to protect personal information.

17. Refusal of Service

A. At any time Meru Holidays retains the right to accept, remove or retain any participant at any time for any reason other than one that is discriminatory or otherwise illegal. A refund equal to the actual cost of the unused services is the limit of Meru Holidays responsibility.

I HEREBY CERTIFY AND AGREE THAT I HAVE CAREFULLY READ, FULLY UNDERSTOOD AND AGREED TO THE TERMS AND CONDITIONS HEREIN. I HAVE BEEN GIVEN THE OPPORTUNITY TO SEEK LEGAL ADVICE BEFORE SIGNING THESE TERMS AND CONDITIONS.
